This policy forms part of the Terms of Service. It applies to consumers - people buying outside their trade or profession - who buy from Foxio at a distance. It sets out the rights given by Directive 2011/83/EU on consumer rights and, in Hungary, Government Decree 45/2014 (II. 26.).
1.The 14-day right of withdrawal
As a consumer you may withdraw from a distance contract within 14 days, without giving any reason and without penalty.
| What you bought | The 14 days run from |
|---|---|
| A subscription or other service | The day the contract was concluded |
| Digital content (courses, storybooks, printables, book packs) | The day the contract was concluded |
| A printed hardcover book | The day you, or someone you nominate, physically receive the goods |
If the deadline falls on a public holiday or a weekend, it extends to the next working day.
2.When the right does not apply
The law lists situations where a consumer has no right of withdrawal. Two of them are directly relevant to Foxio.
2.1Digital content you started using immediately
You lose the right of withdrawal for digital content supplied other than on a physical medium once performance has begun, provided that all three of the following are true:
- you gave your prior express consent for us to begin supply before the 14 days expired,
- you acknowledged that by doing so you would lose the right of withdrawal, and
- we confirmed this to you in writing.
Book packs work the same way. Generations you have not yet used can still be refunded on withdrawal; generations already used cannot, because the book they produced has already been supplied.
2.2Personalised books
There is no right of withdrawal for goods made to the consumer's specification or clearly personalised. A Story Studio book - written around your child, illustrated to resemble your family - is exactly that.
- A digital Generated Book cannot be withdrawn from once generation has started, because it is both personalised and digital content you asked us to supply immediately.
- A printed hardcover cannot be withdrawn from once production has started, because it is personalised goods.
3.What you can always withdraw from
The exceptions above are narrower than they look. You keep the full 14-day right for:
- a subscription, where you have not asked for immediate access - and even where you have, see the next paragraph;
- a book pack to the extent its generations are still unused;
- a course or bundle where you declined immediate access at checkout;
- any purchase where we failed to give you the required pre-contractual information - in which case the withdrawal period extends by up to 12 months.
If you withdraw from a service contract whose performance you asked to begin during the withdrawal period, you pay a proportionate amount for what was supplied up to the moment you withdrew, and we refund the rest.
4.How to withdraw
Tell us clearly, before the 14 days expire, that you are withdrawing. Sending the notice within the period is enough - it does not have to reach us within it.

| Model form | Use the form in section 6, though you are not obliged to |
Any unambiguous statement works. You do not have to give a reason, and we will not ask you to justify yourself. We will confirm receipt without delay.
5.What happens after you withdraw
- We refund all payments received from you, including standard delivery costs, without undue delay and within 14 days of being informed.
- We refund using the same payment method you used, unless you expressly agree otherwise. The refund costs you nothing.
- If you chose a more expensive delivery method than our cheapest standard option, we refund only the standard amount.
- For goods, we may withhold the refund until we receive them back, or until you show you have sent them.
- Access to the withdrawn content ends when the refund is made.
For returned goods: send them back without undue delay and within 14 days of telling us. You bear the direct cost of return. You are liable only for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the goods.
6.Model withdrawal form
Complete and return this form only if you wish to withdraw from the contract. You may also simply write to us in your own words.
- I/We hereby give notice that I/We withdraw from my/our contract of sale of the following goods / for the provision of the following service: ______________________
- Ordered on / received on: ______________________
- Name of consumer(s): ______________________
- Address of consumer(s): ______________________
- Order or invoice number, if known: ______________________
- Signature of consumer(s) (only if this form is notified on paper): ______________________
- Date: ______________________
7.Faulty or non-conforming purchases
Withdrawal is separate from your rights when something is wrong with what we supplied. Those rights are not limited by anything in this policy and are not subject to the 14-day period.
- If digital content or a digital service does not conform to the contract, you may require conformity to be restored, or claim a proportionate price reduction or termination, under Directive (EU) 2019/770 and the Hungarian rules implementing it.
- If a printed book arrives damaged, misprinted or incomplete, tell us and we will reprint and reship it at our cost.
- If a generation job fails for a reason attributable to us, we return the generation it consumed to the pack it came from.
Report a problem to support@foxio.eu with your order number and, for a printed book, a photograph of the defect.
8.Cancelling a subscription
Cancelling is not the same as withdrawing. You may cancel a subscription at any time from your profile; it stops the next renewal and you keep access until the period you paid for ends. Cancelling does not by itself entitle you to a refund of the current period.
Where we have got something wrong, or where a charge was clearly unintended, write to us. We would rather resolve it than stand on the letter of this policy.
9.If we disagree
Contact us first. If we cannot resolve it, you may use the conciliation body, the consumer protection authority or the EU Online Dispute Resolution platform. The full contact details are in section 16 of the Terms of Service.
